My father also has 2 large amount CD’s., when i asked my sister to put my name on one. Her reply was No Way! Since my brother passed early Feb. My sister has taken a lot of money from his accounts. Her name isn’t on the accounts. Her banker is very biased towards me. What can I do to get my name on the CD’s.?
Sister better be keeping good records to where Dads money is going. She is not allowed to personally profit as POA unless the POA says she gets paid. Her name does not need to be on Dads accounts, she is POA. She represents him. But that representation does not mean she can change a Will or beneficiaries on insurance policies or CDs without Dads permission. If he has Dementia, he is not able to make decisions like that and either can sister. When he passes, her POA is revoked. Then the Executor takes over. When his estate is in probate, you can then contest the final accting asking for proof how Dads money was spent in the hands of the POA.
Whose name(s) did your father originally put on the CDs? A POA cannot change a CD beneficiary unless the POA documents specifically says she can, and only if the bank that holds the CD permits this. Most POAs do not include the power to change beneficiaries. She cannot change this just because you want her to.
