My mother lives next door to me. I am her caregiver. I spend 1-2 hours daily with her on average. She doesn't do much of anything anymore although she is mobile and can dress herself and go to the bathroom. Has some dementia so she doesn't even remember to feed her pets. My question is it ok for her to pay me to be her caregiver? We have a signed and notarized contract. We are in Kansas. Will this cause problems if she ever has to go on Medicaid? She lives in a home owned by me and has no assets. Her social security is her only income but it's enough that she can afford to pay a caregiver for 2 hours a day, insurance, and utilities.

You should also include her payments as part of your income taxes just as if she was private paying caregivers

You own her home...

do you need to get paid? If house is getting too expensive to maintain or mom...

does the house have a guest room? Maybe you can rent a room to traveling nurses (?). This may give you an extra eye on mom, a little income..

Yes, if you have a contract, just make sure to get the payments in such a way that there is a clear paper trail.

If you are not currently your Mom's durable PoA I would download that paperwork, and have it legally finalized. Do not co-mingle your assets except to be made joint on her checking and savings account.

If she can pay for aids, make sure the payments are clearly are coming from her account. In most states, the Medicaid look-back period is 5 years. If you have any questions or doubts how to proceed, talk to an elder law attorney.
