As it is not their money, the facility will have to return it, even if it is a small amount. Don't take no for an answer and keep going up the chain till you find someone who will take action. Despicable that they do this, like you don't have enough to do in your grief.

This is how it worked in my State. The Personal Needs Acct becomes part of the deceased person's estate. So does any money that they were allowed concerning assets. This money is theirs not Medicaids. My Mom had a house so I had to do probate. I received a short certificate so I could handle her outstanding bills. I took this and her death certificate to the NH. Their offsite billing dept sent me a check 2 weeks later. Mom had about $186 left in her asset acct and her PNA about $200. I had to set up an estate acct that this money was put into. When the house sold, that money went into that acct. Moms outstanding bills were paid and the balance split between her children.

Medicaid oversees the PNAs. Call and find out how it works in your State. Don't take what the NH says.

Was she on Medicaid when she passed? My MIL's Resident Trust Account funds were recovered by Medicaid (in MN) after she passed.

Kathy, Have you reached out to corporate? Not that you don't deserve it but is the money a significant amount? There was never a large amount in my mother's account. It would be ideal if you owed them money and could deduct this amount from it. Make a nuisance of yourself and of course you could always leave a review indicating this issue. Hope you find some resolution.

Thank you, she passed away December 1st , And we have ask but they keep saying they can't give it to us till we talk to corporate.

It should be returned to you. I was responsible for depositing funds in my late mother's account. She ended up having to move to Skilled Nursing at another facility. She didn't need one there. The AL facility where the personal account was credited the funds towards her final bill once she was moved. You may have to persist with requests. It should be returned.
