I used to be employed by a health care provider. That was years ago. I am needing to know what I have to do to get started with getting employed by a Health care provider for in home health care worker. So, I can get paid to do exactly what I have been doing for free. Please help me out with this information. I'd greatly appreciate it.

Unless you are in a country that funds home care you need to tell this gentleman he will need to start paying out of pocket one way or another, either he can continue to employ you directly (which involves dealing with taxes) or he can hire you or someone else through any agency.

The best situation is if the man (or preferably his FPoA) pays you directly. This would be cheaper and easier for you both. He needs to pay you "above the table" so that you continue to have wages withheld for your Medicare and SSI contributions for when YOU finally retire. Make sure you have a written employment contract. Don't let anyone shame you into working without a contract. It needs to state days, hours, time off, your hourly wage, and what you will and will not do. Also, do not work more than 38 hrs a week. If he needs more than this he needs to hire another aid, or maybe 2. Don't allow "mission creep" to softly lower your hourly wage and burn you out.

Or, you get hired by an agency and they will have you sign a no-compete contract so that you cannot be rehired by your family friend for a span of time. And, there's 0 guarantee he will end up being your client, especially if he needs less than 30 hrs a week in aids.

Medicaid means he will have to qualify both medically and financially. You will not be FT and will make minimum wage.

Or, sign on to Care.com and have him hire you through that platform. They even offer bookkeeping services so he won't have to deal with the whole withholding, reporting and W2 thing.

He's been getting a sweet deal from you all these years. Honestly... shame on him for not paying you.

Talk to some of the agency owners in your area. Many are eager to hire, depending on local demographics. You might start at a basic level and take some classes or training session to improve your skills and credentials.

If they can’t hire you right away, tell this gentleman and his family that you need to be paid. Have an Elder Law attorney draw up a contract so that it will not be seen as gifting should he need Medicaid, and to specify for the IRS whether you are an employee or an independent contractor.

Medicaid will pay you but...he must fit their criteria. A number of States are allowing a friend or family member to train under an agency. You then become an employee of that agency and can be assigned by your friend. This way all your payroll taxes are being taken care of. The County he lives in should have a Social Services Office where you can ask these questions.

Otherwise, this friend will need to pay you.
