We are living apart,because he has an affair with a 35 year old Jamaican woman, we are married for 47years,my ssc is $998 a month, I had to go back full-time work making $15.22 an hour.he makes close to $10.000 a month, His social is $2750 his Army Retirement is $1730 ,he is still working, makes$ 4520 ,he is in high credit card debt, Do he have to pay for assistance living for me.

See an Attorney ASAP...probably should have seen one before you moved out or he moved out. But that is water under the bridge. So make the call now.

See a family law (divorce) lawyer asap, to protect your assets from being scammed/stolen by the mistress or moved and hidden by your husband.

Bring ALL the info you have -- the above income amounts, plus the value of your home (whose name or names is it in), retirement accounts, investment accounts, how many credit cards and whether the debt is joint or his alone, etc. The lawyer can tell you what you are entitled to and suggest various scenarios of staying married but living separately, being legally separated but not divorced, or divorcing. Don't tell your husband until you've decided what you want to do.

Check with your local social security office to find out your status re husband's SS payment. You could be due money. If you aren't due to collect on his amount while he's alive, ask if you'll qualify to step up your amount to his amount once he is dead. You might be entitled to a portion of his army retirement benefit too. Check with the VA about that. You'll need his DD-214 discharge form, so look for it. It has info that the VA will want. After you do these things, you'll have a better idea of what your financial life will look like going forward.

I don't suggest divorcing him until you know what that will involve re your finances. Make an appointment with a divorce attorney. The first appointment is sometimes free. Ask about a legal separation as well as a divorce.

Your husband cannot just waltz off with a floofie cutie and leave you out in the cold. Don't let him! Good luck to you.

You are legally married and half the total assets are yours as well.

See a divorce lawyer for a consult and learn how to protect your assets. The other woman is obviously a scammer and probably knows how to drain your joint assets and will do it rapidly and before you know it you’ll both be broke.. It’s just a consult. Don’t tell your husband.

Does your husband have any cognitive impairment? If so it’s even more urgent to figure things out.
