Did you document the loan with a promissory note or other document evidencing the loan?

I would imagine if your loan is well documented by yourselves you would be in a line of creditors at her death; I am not certain that Uncle Sam doesn't get in the front of most lines?

You will have to prove you paid her AL. Medicaid may not except it.

You probably need to speak with a NAELA certified attorney because isn’t a cut and dry situation. It’s not about proving anything to Medicaid. You might need a promissory note that meets certain requirements. It
does not matter if you have proof you paid for your moms AL. Your state Medicaid program does allow for promissory notes. Without one, Medicaid will consider the money a gift to your mom and they won’t allow her to reimburse you.

Cannot do a promissory note after the fact.

No one is suggesting she get one after the fact. She needs have had one done way back when....
