If I want MLTC for CDPAP services in New York State, do spousal impoverishment rules apply? Or is this for someone applying for nursing home medicaid or HCBS Waivers.

I would say that, unless one of us has gone through this in New York State and has some direction to send you, that this will be best addressed by MLTC and CDPAP itself. Good luck. Once you research this you will be WAY ahead of me and can answer others on this issue.

Yes, you need to see an elder lawyer. See your Office of Aging.

You need to consult a lawyer. This is a very specific and not do it yourself question since you are already on Medicaid yourself.
